ORDERS
The following terms and conditions indicate a customer’s rights and obligations concerning any purchase, order, reception or delivery of any items ordered via the website www.tracteurbits.com

The customer uses the electronic catalogue to select the items that he wishes to purchase and forwards the order to tracteurbits.com using the online order service, following on screen instructions. The catalogue is composed of images and descriptions mentioning the references of models that the items are compatible with. The photos are non-contractual and OEM references are given as a guide. Tracteurbits.com cannot be held responsible for any mentioned OEM references, which are given by the manufacturer of the items. A sale contract is established when the client finalises and validates the order on the website. The contract is then confirmed on our behalf by an automatic email reply, containing a recap of the client’s order. The email contains:
-       The quantity and references of all items ordered
-       The price of the items, including TVA (VAT), and the delivery cost
-       The client’s name
-       The client’s delivery and billing address 

All orders will be processed once the payment is received in full.
In the event of an item becoming unavailable between the confirmation of the order and payment, the client is contacted to inform them of the situation. They are then free to cancel, maintain or modify the order.
Tracteurbits.com cannot be held responsible for any items that are not in stock due to a shortage with the supplier.
Finally tracteurbits.com reserves the right to refuse any order at any time.

PRICES
All prices visible on our website are indicated in Euros including TVA (VAT), not including delivery costs. These prices are only valid for the website tracteurbits.com

In the case of a modification in TVA, be it increase or decrease, these changes will be applied and may affect the prices of our items.

The delivery costs are automatically indicated at the end of the order and are calculated based on the volume, weight and geographical situation of the client (except very heavy/large items).
The delivery charges for very heavy/ large items and palletised items will be communicated/ confirmed via email after the order is placed.

The delivery charges are detailed below in the paragraph “DELIVERY”

Taxes

In the event of an order outside of France metropole or abroad, tracteurbits.com can supply goods Ex TVA to professionals upon presentation of their inter-communal TVA number.
It is up to the client to enquire concerning any taxes that may be applied by the administration of the country to which the order is delivered.

PAYMENTS
Payment of all products and services can be made via :
- Electronic Paypal payment
- Card
- Cheque
- Banker’s cheque (written to “Tracteur Bits”, from a French bank account

All cheques are cashed upon receipt.
All orders must be paid in full before they can be despatched.

DELIVERY
For all orders weighing less than 30kg and inside of France (except heavy/large items) the customer has the choice of delivery at home via Colissimo (without signature), DPD (with signature) or to a point Mondial Relay. Very small items may however be sent via La Poste.

The delivery cost indicated is based on the total weight of the order. These prices are set by the couriers.

For all orders over 30Kg, or in the category of heavy/large palletised items, regardless of the weight, the customer will be informed of the delivery cost via email with a link for payment of any extra fees.

For destinations Outre-Mer (Corse + Outre-Mer), Europe and International sales the delivery cost is worked out individually for each sale.

Please note that although Corse is classed as being part of France Metropole for deliveries it is considered as Outre-Mer and delivery costs will be higher.

HANDLING TIME
All items offered on the tracteurbits.com website will be despatched as soon as possible but we do reserve the right to take up to five working days (except orders containing unavailable items, of which the customer has already been informed).

TRANSPORT – ISSUES
Upon receipt of the delivery the customer must check the condition of the items.

Tracteurbits.com cannot be held responsible for any delay or cancelled deliveries that result from an error in the delivery address that is given by the customer upon confirmation of an order.

In the case of visible or assumed damage to an order/item the customer must inform the courier and indicate “sous reserves” on the delivery note. They then must contact Tracteurbits.com via recorded delivery letter to inform them of the situation within three working days.

In the event of a litigation process and delay depends on the courier ( i.e 21 days with La Poste – Colissimo) Tracteurbits.com cannot be held responsible for the delay incurred by the third party.

RETURNS – CANCELLATIONS
At Tracteurbits.com we pride ourselves on our client’s satisfaction with our products and services.

In accord with the French legislation and article L.121-20 of the Code de Consommation all customers can return any item within 14 days after delivery. The items cost (excluding delivery charge) will then be fully reimbursed according to the original payment method. The 14 days is applicable starting date of delivery.

After the 14 day periode any return request must be made directly with customer services. If accepted the clients account will be credited with an "avoir" to the value of the returned items.

We retain the right to refuse any returns claims made after the 14 day period, for these returns no refund can be made, only avoirs will be issued.  

If an item is thought to have a manufacturing fault or problem, the return fees are to be paid by the buyer. Once returned, the item will be tested. If the item is indeed found to be faulty these delivery fees will be reimbursed and the item exchanged. If the item is found to be in perfect working condition no refund will be made and the item will be returned to the buyer.

UNEXPECTED EVENTS
Tracteurbits.com cannot be held responsible for any unexpected events that may cause delays in the delivery of items, such as strikes, especially with the postal service or couriers, fires, snowfall, natural catastrophes, etc. 

WARRANTY
All items sold on the tracteurbits.com website are supplied with a 12 month supplier warranty (12 months after date of purchase) covering for all manufactural faults.

This warranty covers the item for a full replacement of the item, no other claim can be made. Certain products sold by tracteurbits.com are highly technical and must be fitted by a qualified professional, therefore any queries concerning this type of product must be joined by letter from the qualified mechanic that mounted the items in question. If this is not the case the supplier may refuse the claim as the warranty will be void.

During the warranty period the items must be returned by the buyer at their cost.
To benefit from the warranty the customer must conserve a copy of the original bill.

PERSONAL INFORMATION
The customer has the right to access, modify or cancel any of the personal information that concerns them (art.34 of the “Informatique et libértés” law). To execute this write please contact us at:

LITIGATIONS
The present Terms & Conditions are written in accordance with French law.

In the event of a litigation both parties agree to aim for an amiable solution, before taking any legal action.
